The Warrant Process For Old Traffic Tickets

What is a Capias Warrant?

The United States legal system is based on that of a common law system   In that system, a Capias Warrant is essentially an order to detain a person for the purpose of assuring they will appear in court. The Latin term capias translates into English as “for the taking of,” but it is not commonly associated with the seizure of property or the search of premises. A Capias Warrant should be considered an order of arrest, based on something you did not follow through with.

In most instances, a Capias Warrant is issued in connection with failure to appear before court in a criminal case. A defendant who fails to appear at a criminal court proceeding, for example, could expect a Capias Warrant to be issued for his or her arrest. This is such a serious order that the judge who orders it must assure they have plenty of evidence before sending the order, so this is why it is one that an attorney cannot help you with.

There are two types of Capias Warrants. For the sake of traffic law, we will discuss the one we deal with the most often: Capias Pro Fine

A Capias Pro Fine Warrant occurs when a defendant has failed to comply with a court order related to a judgment, usually in traffic court. For example, a person who is expected to pay a fine or restitution, but does not, for whatever reason,  could be the subject of a Capias Pro Fine Warrant, but this does not automatically imply that they must spend time at a detention center. The accused is brought straight to see the judge. This gives the subject opportunity to show good cause or explain why the judgment has not been fulfilled.
